Electronic Disclosure of the Terms and Conditions Agreement for the Internet Bill Payer Service. This Digital Banking Agreement and Disclosure (“Agreement”) is the contract which covers your and our rights and responsibilities concerning the digital banking services offered to you by University Credit Union (“UCU”). The digital banking service permits you to electronically initiate transactions involving your accounts and communicate with UCU. In this Agreement, the words “you”, “your” and “yours” mean those who request and use digital banking, any joint owners of accounts accessed under this Agreement or any person authorized by you to use your digital banking service. The words “we,” “us,” and “our” mean UCU. The word “account” means any one or more accounts you have with UCU. By requesting and using the digital banking service, each of you, jointly and severally, agree to the terms and conditions in this Agreement, and any amendments. The terms of this Agreement are in addition and subject to the terms of any deposit account agreements you have with us, including the Membership and Account Agreement , Fee Schedule, Funds Availability Disclosure, and Electronic Funds Transfers Agreement, as those agreements may be amended from time to time.

 

We reserve the right to refuse any transaction that would draw upon insufficient or unavailable funds, lower an account below the required balance, or otherwise require us to increase our required reserve on the account.

 

Account Information. The account balance and transaction history information may be limited to recent account information involving your accounts. Also, the availability of funds for transfer or withdrawal may be limited due to the processing time for ATM transactions and our Funds Availability Policy.

 

Fees and Charges. Expedited bill pay may be available for an additional fee. See the most current  Fee Schedule for specific fee information. We will notify you of any changes as required by law.

 

Bill Payer Service. You acknowledge electronic receipt of the Terms and Conditions Agreement ("Agreement") associated with UCU’s Internet Bill Payer Service (“Service”) and agree that you have read and will abide by this agreement. You also agree UCU does not need to provide you with an additional paper (non-electronic) copy of this Agreement unless specifically requested. Further, you understand that a copy of this Agreement can be printed by using your browser's print command and a printer.

 

Use of a Third-Party Bill Payer Service Provider. Payrailz is the third-party bill payer service provider who UCU has contracted with to provide the Service to its members. UCU will answer questions directly related to these member-initiated bill payments. Accordingly, the term "Payrailz" represents the customer service provided by Payrailz to UCU bill payer subscribers on UCU's behalf. UCU, at its sole discretion, reserves the right to change Internet bill payer service providers.

 

Enrollment Request for the Internet Bill Payer Service. UCU reserves the right to refuse enrollment in the Internet Bill Payer Service to any member who does not meet the Internet Bill Pay Service criteria which has been established by the UCU and/or Payrailz. Included in these criteria is a requirement that subscribers to this service must live within the United States, its possessions and territories.

 

Internet Bill Pay Service. As used in this Agreement, the term "Payee" means the vendor, biller, person or entity to whom you wish a bill payment to be directed; "Payment Instructions" means the information provided by you to the Service for a bill payment to be made to your Payee (e.g., Payee name, account number, payment amount, payment date, etc.); "Payment Account" means your Draft (Checking Account) and, in the instance of non-sufficient funds and/or an overdrawn account, any applicable share account or available balance on line of credit accounts (e.g., line of credit overdraft accounts) at UCU, from which all bill payments may be made and/or such funds collected; "Business Day" means Monday through Friday, excluding Federal holidays; "Payment Date" means the Business Day you select for your bill payment to be made and your Payment Account to be debited; and "Cutoff Time" means 5:00 p.m. Pacific Time (PT) on any Business Day, and is the time by which you must transmit instructions to have them considered entered on that particular Business Day. Bill Payment transactions are processed Monday through Friday. Transfers, including bill payment transfers, made after we close our data processing system for the business day, will reflect the next business date before 5:00 p.m. By providing the Service with the names and account information of those entities and/or persons to whom you wish to direct payment, you authorize the Service to follow the Payment Instructions that it receives from you or your authorized user through the Service. When the Service receives a Payment Instruction, you authorize it to debit your Payment Account on the date you select and remit funds on your behalf. For this reason, it is necessary that all Payment Dates selected by you be no less than six (6) Business Days before the actual due date for payments that are being sent by check and three (3) days for ACH payments (not the late date and/or a date in the grace period). It is your responsibility to schedule your bill payments in such a manner that your obligations will be paid on time. Payment instructions entered after the Cutoff Time or on a non-Business Day will be considered entered in the Service on the next Business Day. Funds will be withdrawn from your Payment Account for the bill payment transfer at 5:00 p.m.. Pacific Time (PT) on the date you schedule for payment. The contracted vendor of UCU will process your payment within two (2) business days from the date you instruct us to make the payment. You may cancel or edit any Pending Payment (including recurring bill payments) by following the directions provided on the Internet Bill Pay system . There is no charge for canceling or editing a Pending Payment. Please note we may not have a reasonable opportunity to act on any stop payment or cancellation order given after a payment is "In Process" and it is not possible to stop or cancel a payment which is "Completed." Stop payment requests will be accepted only if we have a reasonable opportunity to act on such a stop payment order and can only be processed on mailed bill pay checks for a fee as disclosed on the current Fee Schedule. The Service will use its best efforts to make all your payments properly. However, the Service shall incur no liability if it is unable to complete any payments initiated by you through the Service because of the existence of any one or more of the following circumstances: (a) acts of God; (b) flood, fire, earthquake, or other natural disaster or explosion; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order or law; (e) actions, embargoes or blockades in effect on or after the date of this Agreement; (f) action by any governmental authority; (g) national or regional emergency; (h) strikes, labor stoppages or slowdowns or other industrial disturbances; (i) epidemic, pandemic or similar influenza or bacterial infection (which is defined by the United States Center for Disease Control as virulent human influenza or infection that may cause global outbreak, or pandemic, or serious illness); (j) emergency state; (k) shortage of adequate medical supplies and equipment; (l) shortage of power or transportation facilities and power outages; and (m) other similar events beyond the reasonable control of UCU; (m) if the Payee mishandles or delays a payment sent by the Service; (n) if you do not have sufficient funds in your Payment Account to make the payment;

 

UCU may, at its option, pay a scheduled bill payment which exceeds the balance in the checking account by transferring the amount of the resulting overdraft from your available line of credit, courtesy pay or share account, as provided in the Membership and Account Agreement.

 

If the Payment Service causes an incorrect amount of funds to be removed from your Payment account or causes funds from your Payment Account to be directed to a person or entity which does not comply with your Payment Instructions, the Payment Service shall be responsible for returning the improperly transferred funds to your Payment Account and for directing to the proper recipient any previously misdirected payments or transfers. Payment will be made to your Payee either electronically via the Automated Clearing House (ACH) or by check. The method of payment depends upon the processing method that can be accommodated by the Payee or Payrailz (e.g., some Payees are unable to accept electronic payments). All bill payments debited from your account will appear on your monthly Statement. They will also appear under the "BILL PAY HISTORY" section of the Internet Bill Pay on UCU digital banking. All payments can be viewed with the Payee's name, payment amount and payment date by reviewing your recent payment history under the electronic Payment List option provided to you as part of the Service.

 

Prohibited Payments.

The following payment types are prohibited through the Service:

  • Tax Payments
  • Payments to Payees outside of the United States or its possessions/territories

 

Expedited Payment Service.

The Expedited Payment Service (“Expedited Service”) allows you to submit payments to merchants that will be posted to your account with that merchant via expedited means, within the parameters of the Service and other parameters established by the vendors receiving these payments. The available services shall include paper check payments funded from your Payment Account.

 

All payments will be initiated in an expedited manner, and you will receive an explicit delivery expectation for every payment. For overnight checks, payments initiated prior to the daily cutoff time will be delivered by the next business day.

 

Hours of Access. You can use the Expedited Service seven days a week, twenty-four hours a day, although some or all services may not be available occasionally due to emergency or scheduled system maintenance, updates or repairs or for other reasons beyond our control.

 

Expedited Payment Service Limits. You will not be able to schedule an Expedited Payment for an amount greater than the balance displayed within the bill payment service for the Payment Account at the time you attempt to schedule the payment. Additionally, for risk management and security purposes, the Expedited Service limits the number of payments and the total amount of payments that you may make per day. You will receive an error message and be prevented from fully executing any transaction that exceeds these limits. From time to time, we may modify the limits to the frequency or amount of transfers you can make using the Service. We do not disclose these limits for security purposes. In any event, funds transfers in excess of the then-applicable limits will not be completed.

 

The Service may not be available for payments to all merchants.

 

Fees and Other Deductions. The Expedited Service is a transaction-based service. For each Expedited Payment, a fee of $27.00 will be added to each transaction requiring an expedited paper check. There are no monthly or recurring fees associated with the Service.

 

Credit Union's Liability for Expedited Payments. If we do not complete a properly-submitted Expedited Payment on time or in the correct amount according to our agreement with you, we will be liable for up to a maximum of fifty dollars ($50.00) on any late fees and/or finance charges assessed against you for the late posting of such payment, excluding any fees or charges assessed on your total outstanding balance with that merchant ("Penalties"). We will not be liable for consequential damages that might arise from the payment not arriving in time. UCU will not have any liability to you for any of the following:

  • Late delivery or non-delivery of a check due to an incorrect or insufficient address on an overnight check transaction or delays in postal or carrier service.
  • If the payment amount is incorrect.
  • If the payment is scheduled after the due date of the payment or is scheduled without sufficient time to complete the payment by its due date.
  • If you did not provide us accurate information to successfully complete the payment
  • If you do not have enough money in your account to complete the transfer
  • If you are unable to schedule a payment because you have exceeded the daily risk management limits
  • If you are unable to schedule a payment because the merchant does not participate in this service
  • If you are unable to schedule a payment because the system is unavailable

 

Expedited Payments are available for a limited number of payees. Expedited overnight checks are not available for delivery to PO Box addresses or locations in Alaska, Hawaii, or any foreign or U.S. territory outside of the contiguous 48 states and District of Columbia. You are responsible for entering and verifying any address for overnight check payments to ensure it is correct and is specified as a valid overnight package address by the biller.

 

Due to the inherent need to expedite the payment, payment instructions will be completed immediately upon submission of a request from you. You will not have the ability to edit or cancel the payment instruction after you confirmed the payment request.

 

Your Liability for Unauthorized Transfers. If you tell UCU within two (2) Business Days after you learn of unauthorized access to your account(s) and/or that your UCU digital banking login credentials have been lost, stolen or compromised, you can lose no more than $50.00. If you fail to notify UCU within two (2) Business Days after you learn of unauthorized access to your account(s) and/or that your UCU digital banking username and password has been lost, stolen or compromised, and we can prove that we could have prevented the unauthorized access to your account(s), or use of your UCU digital banking username and password had you notified us, you could lose as much as $500.00. If your monthly statement or your online account detail reflects any transfers or payments that you did not make, tell us at once. If you do not tell us within sixty (60) days after the first statement which reflected an unauthorized transfer(s) or payment(s) was mailed to you, you may be liable for the entire amount of any unauthorized transfers that occur after the close of the 60 days and before notice to us, and that we can establish would not have occurred had you notified us within the 60–day period, and we may not be able to assist you in disputing the transaction.

 

Errors and Questions. In case of errors and questions about your electronic transfers or payments, as soon as you can, you should call us at 800.UCU.4510, send us a secure message within your digital banking, or write to us at University Credit Union, 1500 S Sepulveda Blvd., Los Angeles, CA 90025. If you think that your statement is wrong or you need more information about a bill payment listed on the statement, we must hear from you no later than (60) days after you received the FIRST statement on which the problem or error appeared.  You must:

  1. Tell us your name and account number.
  2. Describe the error or the transfer you are unsure about and explain as clearly as you can why you believe it is an error or why you need more information, and
  3. Tell us the dollar amount of the suspected error.

If you tell us orally, in person, or by telephone we may require that you send us your complaint or question in writing within ten (10) Business Days* after providing verbal notification.  We will tell you the results of our investigation within ten (10) Business Days* after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty-five (45) days to investigate the complaint or question. If we decide to do this, we will re-credit your account within ten (10) Business Days* for the amount you think is in error, so that you may have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) Business Days*, we may not re-credit your account. If we determine there was no error, we will send you a written explanation within three (3) Business Days after we finish the investigation. We may revoke any provisional credit provided to you if we find that an error did not occur. You may ask for copies of documents which we used in our investigation.

 

*If you give notice of an error within thirty (30) days after you make the first deposit to your account, we will have twenty (20) business days instead of ten (10) business days.

 

Disclosure of Account Information to Third Parties.

It is our general policy to treat your account information as confidential. However, we will disclose information to third parties about your account or the transfers you make ONLY in the following situations: 

  1. If we return transfers or payments made from your account which are drawn on insufficient funds or if we are unable to complete an electronic transfer or payment because of insufficient funds, or
  2. Where it is necessary for completing transfers, or
  3. In order to verify the existence and condition of your account to a third party, such as a credit bureau or merchant, or to a consumer reporting agency for quality assurance.
  4. In order to comply with a governmental agency or court orders, or
  5. If you give us your written permission.

Charges or Fees. Charges for transactions, additional, and optional services (e.g., Non-Sufficient Funds or Stop Payment Fees) are specified in the UCU Fee Schedule which can be found on the UCU web site. You agree to pay such fees and charges and authorize the Service to charge your designated Payment Account for these amounts and any additional charges that may be incurred by you. Further, you also agree that a fee may be charged to your Payment Account even if the payment is not returned but is paid and overdraws your Payment Account. By enrolling in and using this Internet Bill Pay service you agree that UCU has the right to transfer funds from your available balance on your line of credit account as well as from all of your share accounts to recover funds for all payments that have been requested to be paid by you and your authorized user: this includes accounts on which you are the primary member-owner, as well as accounts on which you are the joint owner.

 

Alterations and Amendments. The terms of this Agreement, applicable fees and service charges may be altered or amended by the Service from time to time. In such an event, the Service shall send notice to you at your address of record or by secure electronic message via the UCU digital banking service. Any use of the services after the service sends you a notice of change will constitute your agreement to such change(s). Further, the Service may, from time to time, revise or update the programs, services, and/or related material, which may render all such prior versions obsolete. Consequently, the Service reserves the right to terminate this Agreement as to all such prior versions of the Internet Bill Pay programs, services, and/or related material and limit access to the Service's more recent revisions and updates.

 

Address Changes. You agree to promptly notify both UCU of any address change and change it on your online Bill Payment Profile. Changing your address on the Service may not necessarily automatically update your address of record at UCU. Similarly, updating your address at UCU may not necessarily automatically update the address on the Service.

 

Payee Limitations. The Service reserves the right to refuse to pay any person or entity to which you may direct a payment. The Service is obligated to notify you promptly if it decides to refuse to pay a person or entity designated by you. This notification is not required if you attempt to pay tax or court-related payments or payments outside the United States and its possessions/territories (American Samoa, Guam, Marshall Islands, Micronesia, N. Mariana Islands, Palau, Puerto Rico and the Virgin Islands), which are prohibited under this Agreement.

 

Information Authorization. Through your enrollment in the Internet Bill Pay Service, you agree that UCU (or its third-party bill pay service provider) reserves the right to obtain financial information regarding your account from a merchant or financial institution to resolve payment-posting problems.

 

No Waiver. The Service shall not be deemed to have waived any of its rights or remedies hereunder unless such waiver is in writing and signed by the Service. No delay or omission on the part of the Service in exercising any rights or remedies shall operate as a waiver of such rights or remedies or any other rights or remedies. A waiver on any one occasion shall not be construed as a bar or waiver of any rights or remedies on future occasions.

 

Security Statement. UCU is committed to ensure the confidentiality of your online transactions. Our banking products incorporate security features for safeguarding your accounts and the information you transmit to us during a session.

 

System Requirements.

The minimum encryption requirement for accessing credit union account(s) online is TLS 1.2 protocol with forward secrecy and 128-bit (or higher) encryption ciphers, which are the supported defaults for these operating systems, browsers, and versions.

 

In addition, JavaScript must be enabled, web extensions must be disabled, ensuring the most optimal experience.
