The terms of this Agreement apply to consumer, business and organization EFT users in the same manner, except as specifically provided.

YOU may use YOUR computer, laptop, phone, tablet, or other computing device ("Computing device") to access YOUR accounts. YOU will need a computing device and access to the Internet or data, and UCU's Mobile Banking Application. YOU must use YOUR access code (password) along with YOUR username to access YOUR accounts. The online banking services are accessible 7 days a week, 24 hours a day. YOU are responsible for the installation, maintenance and operation of any software and YOUR computing device. YOU agree that YOU are and will remain fully responsible for any transactions made by such persons on YOUR accounts except transactions that occur after UCU has been notified of any revocation of authority and has had a reasonable opportunity to act upon such notice.

Transactions involving YOUR deposit accounts will be subject to the UCU Membership and Account Agreement and transactions involving a loan account will be subject to YOUR Loan Agreement and Disclosures.

Pay A Person (“P2P”) Terms. Transfers using P2P service are subject to the P2P Terms of Service and certain limitations that will be disclosed to you at the time you initiate the service. P2P is a service that allows YOU to send money via Online Banking or Mobile Banking to others using a cell phone number or an email address through a network we select.

a. Payment Network Relationship with You. The payment network we select is a payment service provider that helps you make payments to third parties. It is an independent contractor for all purposes, except that it acts as your agent with respect to the custody of your funds only. The payment network does not have control of, or liability for, the payment for products or services with our service. We are not responsible for the identity of any recipient to whom you have authorized a payment or ensure that a recipient will complete a transaction.

b. Eligibility for P2P Payments. You authorize UCU and the payment network, directly or through authorized third parties, to make any inquiries considered necessary to validate your identity. This may include asking you for further information, requiring you to take steps to confirm ownership of your email address or financial instruments, ordering a credit report and verifying your Information against third party databases or through other sources. UCU will, at its sole discretion, authorize the use of P2P and may at its sole discretion disallow the use of P2P payments from any UCU member.

c. Making Transfers.

i. Transfers. When an Online Banking P2P Payment is made, the funds are immediately transferred from your account for Transfer and are credited to the payment network to provide funds to the recipient. You agree that such requests constitute your authorization to us and the payment network to make the Transfers. Once you have provided your authorization for the Transfer, you may not be able cancel the electronic Transfer.

ii. Refused and Refunded Transactions. When YOU send money, the recipient is not required to accept it. YOU agree that you will not hold the payment network or UCU liable for any damages resulting from a recipient's decision not to accept a payment made through the service. If a payment is unclaimed, denied or refunded for any reason, we will return the money to YOUR Account within 30 Days of the date YOU initiate payment. If a recipient does not have an account with the payment network, and does not set one up within 30 days of YOUR transaction date, you can request that the funds are returned to YOU before the 30-day period by using the return function in the online banking P2P screen.

Bill Payment Service

Paying bills using UCU Bill Payment Service is subject to the Bill Pay Agreement that will be disclosed to you at the time you initiate the service. The Bill Payment Service permits YOU to use YOUR Internet enabled device to direct payments from YOUR designated online Bill Payment Account to third parties YOU wish to pay. YOUR Bill Payment Account must be a primary checking account. Through the Bill Payment Service, YOU can pay bills from YOUR Bill Payment Account to businesses or individuals.

All payments YOU make will be deducted from the checking account that YOU designate as YOUR Bill Payment Account for the Bill Payment Service. Any payments YOU wish to make through this Service must be payable in U.S. dollars to a payee located in the continental United States. We reserve the right to restrict the types of payees to whom payments may be made using the Service from time to time. YOU should not use the Bill Payment Service to make payments to settle securities purchases, payments to interest bearing accounts, tax payments, or court ordered payments.

Payments for these payees will be YOUR sole responsibility if delayed or improperly processed or credited.

Scheduling Payments. Funds must be available in YOUR Bill Payment Account on the scheduled payment date. If the date YOU schedule a payment to be initiated falls on a non-business day (Saturday, Sunday, or holiday), funds must be available in YOUR Bill Payment Account the following business day (e.g. Monday). After funds are withdrawn from YOUR Bill Payment Account to make a payment, we may make the payment either by transferring funds electronically to the payee or by mailing the payee a check.

YOU may choose to schedule payments to recur in the same amount at regular weekly, monthly, or semi-monthly intervals. YOU should schedule a payment to a new payee at least ten (10) business days before any payment due date, to allow us time to set up the payee and verify information about YOUR account with the payee.

No Duty to Monitor Payments. UCU is only responsible for exercising ordinary care in processing and sending payments upon YOUR authorization in accordance with this Agreement. UCU will not be liable in any way for damages YOU incur for any of the following reasons:

  • Insufficient funds in YOUR Bill Payment Account to make the payment on the processing date;
  • Delays in mail delivery;
  • Changes to the payee's address or account number unless we've been advised of the change in advance;
  • The failure of any payee to correctly account for or credit the payment in a timely manner, or;
  • Any other circumstances beyond the control of UCU.

If the session during which YOU schedule a payment or transfer ends by 2:00 pm PST., UCU will be considered to have received it on that day. Otherwise, it will be considered received on the following business day. For all entries made using the Services, the time recorded by the Online Banking Service will be considered the official time of the transaction.

If YOUR Bill Payment Account does not have sufficient funds to make a payment as of the date the payment is debited to YOUR account, the Bill Payment Service will automatically block future Bill Payment Service until the account has sufficient funds to make the payment. UCU will attempt to notify YOU by e-mail or U.S. Postal Mail, but UCU shall have no obligation or liability if it does not complete a payment because there are insufficient funds in YOUR account to process a payment. In all cases, YOU are responsible for either contacting UCU to either make alternate arrangements for the payment or reschedule the payment through the Service. In the case of fixed payments, only the payment currently scheduled will be impacted. Fixed payments scheduled for future dates will not be affected.

Cancel or Change Payment Instructions. You may cancel or edit any Pending Payment (including recurring bill payments) by following the directions provided on the Internet Bill Pay system. There is no charge for canceling or editing a Pending Payment. Please note we may not have a reasonable opportunity to act on any stop payment or cancellation order given after a payment is "In Process" and it is not possible to stop or cancel a payment which is "Completed." Stop payment requests will be accepted only if we have a reasonable opportunity to act on such a stop payment order and can only be processed on mailed bill pay checks for a fee as disclosed on the current Fee Schedule. The Service will use its best efforts to make all your payments properly.

No Signature Required. When any payment or other online Service generates items to be charged to YOUR account, YOU agree that we may debit YOUR Bill Payment account without requiring YOUR signature on the item and without prior notice to YOU.

Service Limitations

The following limitations on the availability and number and dollar amount of transactions may apply in using the online banking services listed above:

  • YOU may transfer or withdraw up to the available balance in YOUR account or available credit line at the time of the transfer, except as limited under other agreements.

YOU may make funds transfers to YOUR accounts or other accounts YOU authorize as often as YOU like. UCU reserves the right to refuse any transaction that would draw upon insufficient or unavailable funds, lower an account below a required balance, or otherwise require us to increase our required reserve on the account.

Termination of service will be effective on the first business day following receipt of YOUR written notice. However, termination of this Agreement will not affect the rights and responsibilities of the parties under this Agreement for transactions initiated before termination.

you agree to be bound by the rules contained in this Agreement.

NO OTHER WARRANTY IS PROVIDED OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

YOU shall be provided with notice of any claims and given full authority and assistance (at YOUR own expense) for the defense of any such claims, provided that UCU may participate in such defense and settlement with counsel of UCU’s own choosing at UCU’s own expense.
